A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5A-3-58, relating to
requiring the Director of the Purchasing Division of the
Department of Administration to establish a Vendor Performance
Evaluation Program.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5A-3-58, to read as
follows:
ARTICLE 3. PURCHASING DIVISION.
§5A-3-58. Vendor performance evaluation program.
The Director shall establish a vendor performance evaluation
program. The program shall include:
(1) Procedures and forms to be used by state agencies in
evaluating vendor performance under contracts, whether awarded
under this article or other authority;
(2) Procedures to be used by the Division in using information gathered under the program in evaluation of vendors seeking
contracts with the state; and
(3) Procedures to be used in allowing vendors to respond to
information submitted by agencies.
NOTE: The purpose of this bill is to
require the Director of
the Purchasing Division of the Department of Administration to
establish a vendor performance evaluation program.
